jigsaw puzzle and prefers to withhold an opinion until enough pieces are
in place.
After studying the details you provide, Larry will project what
kind of reception the statements and discovered facts would get if they
were presented by each side to a Hearing Panel during a Professional
Standards hearing at the Board of Realtors.
This mental exercise works to reduce arbitrariness on the part of the
Expert by taking into account the fact that other Realtors might view the
questioned conduct in a different light. ("I will sometimes ask
other Realtors how they would vote on an issue, which I present to them in
basic terms. This usually help me stay focused upon the core issues.")
The exercise ends when the virtual panel either dismisses the charges or
finds that the respondent's conduct is in violation of one or more
Articles of the Code. Of course, it's much easier when the
evidence is prima fascie.
There can also be mixed results, with some charges dismissed and others
upheld. This is very important when a Realtor's conduct may be in
violation of an Article that has no bearing on the allegations spelled out in a
lawsuit. If the other side hires their own Ethics expert, this violation
will surely be identified and exploited at trial. ("This happened
in a recent case when the plaintiff's expert tried to make a big deal out
of alleged -- but unproven -- violations of license law. I stated
that not only was there no evidence of such violations, but even if they
were proven, they were unrelated to the principal question of the case." )
As to the law
Although the statutes are
fairly straightforward, there are many unexplained gray areas that give
rise to innumerable, "But what if...?" questions. Larry's clear

license renewal course materials -- can help with finding answers to the
knotty questions.

but he will demonstrate them gracefully, creatively, and convincingly to
judge and jury. He can also create appropriate graphics when necessary.
