Abstractions of some issues
Case 1: Realtor A was sued for substantial damages by a
home buyer who claimed that the Realtor knew of hidden damage to the home
but did not inform him before the closing. "Based on the
depositions and exhibits, I demonstrated that a concealment complaint
would be dismissed by a hearing panel." The parties
settled out of court after a bitter 5-year battle.
Case 2: Broker A sued for compensation from Broker B
after a commercial property was sold. Not Realtors, the parties did not submit the
matter to arbitration, but "I analyzed the events and went through the
process as if they did and submitted my conclusion to his client,
Broker B, and the broker's attorney."
Case 3: Buyer claimed that he was treated fraudulently
by a Realtor in the course of a large transaction. "Reviewing the
virtual process from beginning to end, it was clear to me that the Realtor
had acted both unethically and in violation of state law.
The parties settled out of court.
Case 4: Buyers' suit for damages was based on
inaccurate information shown in printed marketing materials, and alleged that
the Realtor knew the information to be wrong when the materials were
prepared. "While there was no doubt about the data being
incorrect, I could show that a complaint on Articles 1 & 2 --
dishonesty and concealment -- would be dismissed after a hearing was held."
The case was settled before trial.
Case 5: Realtor A sued Realtor B for interfering with
A's agency and customer relationships, along with other charges. "Based
on the materials provided, I concluded that Realtor B's conduct would most
likely be judged in violation of several articles of the Code. And,
sadly, that the defendant may also have been operating in violation of
Florida's licensing laws."
Case 6: Buyers
and sellers in a failed transaction were suing each other and Realtors
were in the crossfire. After a thorough review, I advised the
attorney for the sellers that in my opinion, the buyers' Realtors had
acted ethically, the sellers' Realtors did not, and his clients' position
was difficult to defend. I then proposed that his clients should
settle. (Prologue. his clients paid to settle.)
