Larry Lowenthal is a nationally recognized Real Estate Expert Witness
who has been retained by dozens of attorneys across the United States since 2003 to analyze failed or troubled real estate transactions where questions about a real estate broker's conduct and Realtor ethics are an issue.

"I think you are the first in Florida to get something through the professional standards process at the National Association of Realtors."
C.G., Professional Standards Trainer, Florida Realtors

Based in Florida, he is also retained to help with substantial commission or fee disputes, procuring cause claims, and allegations regarding breach of contract by buyers or sellers, usually in commercial property transactions.

"Thanks for your honesty, all your thoughts and
professional input. You did a great job analyzing
            this without living thru it!"

Retaining Realtor/buyer

Larry is retained either as a testifying expert or a consulting expert when a private opinion is needed. Insurance Defense attorneys retain Larry when their broker clients are charged, while plaintiffs and their attorneys retain him when charging real estate brokers with improper conduct.

Larry is not an attorney, but a private Real Estate Broker licensed in Florida.  For many years, Larry was a Realtor with well-known firms ( Coldwell Banker, ERA, Realty World, and Century 21), but is now independent.

"His knowledge, coupled with his courtroom presence,
makes Mr. Lowenthal a real threat to the other side."

 1. Are you a buyer or seller considering filing a lawsuit
against a real estate broker or agent for malpractice?

If you're considering legal action against a real estate broker for malpractice, and upon the advice of your attorney, it's prudent to retain an expert witness. We specialize in real estate matters and can provide valuable insights during litigation. Here are some key points to consider:
- Expertise: Real estate brokerage expert witnesses have in-depth knowledge of the industry. We can testify on various aspects, including broker statutory obligations, liability, Realtor ethics, fiduciary duty (if applicable), compliance, and standard of care.
- Areas of Testimony:  We can provide testimony related to real estate transactions, broker malpractice, contractual disputes, and agent/broker standards. We can also address issues like misrepresentation, failure to disclose known but hidden material matters, negligence, fraud, commission disputes, and breach of duty.
- Case-Specific Assistance: An expert witness can help you understand complex real estate concepts, evaluate the broker's actions, and assess whether malpractice or negligence occurred.
As long as the facts and law are on your side, experts can provide reports, analyses, and professional opinions to support your case.
- Standard of Care: In malpractice cases, an expert witness can opine on whether the broker adhered to the industry's standard of care. This assessment is crucial in determining whether the broker's actions met acceptable norms.

Larry Lowenthal is not an attorney and does not provide legal advice, but retaining an expert witness can significantly strengthen your case by providing objective insights and supporting your claims. Consult a litigation attorney to help decide if I am the right expert for you. (Please note: if I conclude that the broker's conduct was acceptable, I will promptly inform you or your attorney)

  2. Are you a real estate broker or agent facing a lawsuit
      charging professional malpractice or negligence?

Almost certainly, you will have to retain an attorney to defend your interests, and unless there is an early settlement, your team will probably need an expert witness to help, because attorneys do not opine upon or argue real estate license law, the standard of care, or Realtor ethics.

I've been doing just that in several states for over twenty years.
